These Terms of Service (“Terms”) govern your use of the LumoCue website, products, software, and related services.
LumoCue is operated by AutoFrax LLC (“AutoFrax,” “LumoCue,” “we,” “us,” or “our”).
By accessing our website, purchasing a LumoCue product, downloading or using LumoCue software, or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, please do not use the applicable products or services.
1. About LumoCue
LumoCue is a physical attention and status indicator designed to provide visual, audio, and/or tactile cues associated with supported computer software and AI-agent activity.
Depending on configuration and software support, LumoCue may indicate states such as:

Blue — AI is working

Red — AI needs your attention

Green — task complete or ready
Features, colors, behavior, integrations, and software functionality may change as the product develops.
2. LumoCue Is an Attention Aid
LumoCue is intended to help users notice software or AI-agent states without continuously watching a computer screen.
LumoCue is an attention and notification aid.
It is not intended to guarantee that every software event, AI request, error, completion, or other condition will be detected or communicated.
Users remain responsible for monitoring and controlling their computers, software, AI agents, and workflows when appropriate.
3. User Control and AI Actions
LumoCue may alert you when compatible software or an AI agent appears to require attention.
A LumoCue alert does not itself approve, authorize, confirm, execute, or validate an action requested by an AI system.
Where LumoCue provides a physical acknowledgement function, such as a button or tap, that interaction is intended to acknowledge or interact with the LumoCue system as implemented.
You remain responsible for reviewing any request, command, permission, code, file operation, transaction, or other action presented by the underlying software or AI service before approving it.
Do not rely on LumoCue as the sole safeguard for consequential computer operations.
4. Third-Party Software and AI Services
LumoCue may operate with or alongside third-party software, developer tools, operating systems, AI agents, or AI platforms.
Those third-party products and services are owned and operated by their respective providers and are governed by their own terms, policies, availability, and technical requirements.
Unless expressly stated otherwise, AutoFrax LLC and LumoCue are independent from and are not affiliated with, endorsed by, sponsored by, or approved by third-party AI or software providers.
References to third-party products or services are provided only to describe compatibility or potential use.
Third-party software updates may occasionally affect LumoCue compatibility or functionality.
5. Compatibility
LumoCue requires compatible hardware, operating systems, software, connections, and configurations.
Compatibility information provided on our website reflects the configurations we have tested or currently support.
We may add, modify, or discontinue support for particular operating systems, AI tools, applications, or integrations as technology changes.
Customers should review current compatibility information before purchasing or installing LumoCue.
6. Software
Certain LumoCue functions may require companion software, scripts, drivers, extensions, configuration files, or other software components.
We may periodically provide updates, bug fixes, compatibility improvements, security improvements, or new functionality.
You are responsible for maintaining a reasonably compatible and secure computing environment.
Unless otherwise stated, your purchase of LumoCue provides you with a limited, non-exclusive, non-transferable right to use the accompanying LumoCue software for its intended purpose with your LumoCue device.
You may not reverse engineer, reproduce, redistribute, resell, or commercially exploit proprietary LumoCue software except where such restrictions are prohibited by applicable law or where we expressly authorize such use.
Any open-source components included with LumoCue remain subject to their applicable open-source licenses.
7. Experimental and Evolving Features
LumoCue is an evolving technology product.
Some features, integrations, software functions, or compatibility options may be introduced, modified, tested, improved, or discontinued over time.
Beta, preview, experimental, or early-access features may contain errors or behave differently from final production features.
Customers should not rely on experimental functionality for safety-critical, mission-critical, medical, emergency, financial, industrial-control, or similarly consequential applications.
8. Not a Safety-Critical Device
LumoCue is a productivity and attention device.
It is not a medical device, emergency notification system, security system, industrial safety system, life-safety system, or other safety-critical notification device.
Do not use LumoCue as the sole means of detecting or communicating conditions where failure, delay, incorrect indication, loss of power, software malfunction, or network interruption could result in injury, significant property damage, or other serious consequences.
9. Orders and Payment
Products offered through our website are subject to availability.
Prices, promotions, product configurations, and availability may change without notice.
You agree to provide current, complete, and accurate purchase and account information when placing an order.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing errors, product unavailability, or other order-processing problems.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
10. Shipping
Physical product orders are subject to our Shipping Policy.
Shipping and delivery dates are estimates unless expressly stated otherwise.
Delays caused by carriers, weather, transportation disruptions, incorrect addresses, customs, or other circumstances outside our reasonable control may occur.
11. Returns and Refunds
Returns, replacements, and refunds are governed by our Return & Refund Policy.

12. Product Appearance and Specifications
We make reasonable efforts to accurately display LumoCue products, photographs, colors, specifications, and features.
Computer and mobile displays may reproduce colors differently.
Because LumoCue is an evolving product, minor cosmetic, manufacturing, packaging, component, or software differences may occur between product images and the product delivered, provided those differences do not materially alter the product's intended basic functionality.
13. Acceptable Use
You agree not to use LumoCue, its software, or our website:

to interfere with or compromise computer systems or networks;

to distribute malicious software;

to infringe intellectual-property rights;

to interfere with another person's systems or data; or

in a manner inconsistent with applicable laws or regulations.
14. Intellectual Property
The LumoCue name, branding, product designs, graphics, website content, software, documentation, photographs, videos, and other proprietary materials may be protected by trademark, copyright, patent, trade-secret, or other intellectual-property rights.
Except for the limited rights necessary to use a purchased LumoCue product and accompanying software, purchasing LumoCue does not transfer ownership of our intellectual property.
Nothing in these Terms grants permission to reproduce, manufacture, sell, license, or commercially exploit LumoCue intellectual property without written authorization.
15. Feedback
If you voluntarily provide ideas, suggestions, bug reports, feature requests, or other feedback concerning LumoCue, you permit us to use that feedback to evaluate and improve our products and services without an obligation to compensate you.
This provision does not transfer ownership of inventions or confidential information that is separately protected by a written agreement with AutoFrax LLC.
16. Availability and Interruptions
We do not guarantee that the LumoCue website, software, integrations, or connected services will operate continuously or without errors.
Operation may occasionally be affected by maintenance, updates, third-party software changes, computer configuration, operating-system changes, network interruptions, hardware failures, or other circumstances.
17. Disclaimer of Warranties
To the extent permitted by applicable law, LumoCue products, software, websites, and services are provided on an “as is” and “as available” basis except for any express warranty we specifically provide in writing.
We do not warrant that LumoCue will detect every AI-agent state, notification, software event, completion, interruption, or request for attention.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, AutoFrax LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of or inability to use LumoCue.
This includes, where permitted by law, losses resulting from missed notifications, software errors, third-party AI behavior, interrupted workflows, loss of data, lost productivity, or third-party service failures.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Privacy
Your use of our website and services is also subject to our Privacy Policy.
The Privacy Policy explains how information may be collected, used, and handled in connection with the LumoCue website and services.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, business practices, or applicable requirements.
The current version will be posted on our website with an updated revision date.
Your continued use of the services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
21. Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
22. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
23. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and other policies expressly incorporated by reference, constitute the applicable agreement between you and AutoFrax LLC concerning your use of the LumoCue website, products, and services.
